Auction step. Advantages of electronic procurement

After confirmation of accreditation, it is necessary to open a special bank account. Funds are transferred to it to secure the auction bid.

The amount of security for each auction is set by the customer in the range from 0.5% to 5% of the initial contract price. In the event of a win and withdrawal from the contract, these funds are retained and transferred to the customer. Until the electronic auction takes place, this money will be blocked.

If you don't win, the collateral will be returned within 5 working days. If you win, then the application security will also return, but after making the contract security and signing it.

Step 5. Applying for an auction

An application for an auction can be submitted if funds have been credited to the personal account to ensure it.

  • An electronic auction on the site is searched for by registry number
  • Application forms are filled in personal account, loading documents
  • Each file and the final application form are signed with digital signature

After submission, each application is assigned a serial number. On some sites, it corresponds to the number of applications submitted, it can be used to determine how many participants in total. If there are doubts about the correctness of the documents, the application can be withdrawn and resubmitted. It will be assigned a new serial number.

Step 6. Consideration of the first parts of applications

The auction commission of the customer, up to 7 days, considers the first parts of applications and makes a decision: to allow up to electronic trading or reject. The name of the company in the first part is classified until the consideration of the second parts.

Based on the results of consideration at the site, a protocol is published with application numbers and a decision on admission. Company names remain hidden.

Step 7. Participation in the electronic auction

In case of admission to the bidding procedure, it is important not to miss the time of the electronic auction. This is usually the third working day after the publication of the admission protocol.

Possible confusion with time zones. The auction can take place early in the morning or at night, last for hours. You need a reliable Internet and a backup channel, an uninterruptible power supply or a laptop (and Charger!), checking the functionality of the EDS.

There are many more overlays than you can imagine.

How is the auction conducted? When a trading session opens on the site, participants can submit price offers. The auction step is from 0.5 to 5% of the initial contract price. Time to submit an offer - 10 minutes. After each new rate 10 minutes are counted down again.

You always have 10 minutes to decide on a new bet.

You can have time to drink a cup of coffee, make and agree on a decision. Ten minutes after last bid the main auction ends. The first place is taken by the offer with the minimum price. But that is not all.

The second part of the trading session begins, where any participant can place a price outside the auction step and take second place.

There are 10 minutes for this. In case of rejection of the auction winner's application for the second parts, the contract will be signed with the next participant in turn. Additional submission to electronic auction- This milestone, which increases the chance of winning.

Under term of the electronic auction according to 44-FZ, they imply a period of time allotted for each stage of the procurement. Let us consider in more detail how many stages there are in total and in what terms, according to the law, they must pass.

If the NMTsK is less than and equal to 3 million rubles, then the minimum time for concluding a contract 21 day.

If the NMTsK is more than 3 million rubles, then the minimum time for concluding a contract 29 days.

1. The very first step in organizing an electronic auction is the placement of a notice of its holding and tender documentation. Here, the auction period under 44-FZ varies depending on the amount of the NMTsK: if it exceeds 3 million rubles, then the notice must be placed for 15 days(or more) before the closing date for applications. If the amount is 3 million rubles. and less - then for 7 days(or more).

2. There are times when it is necessary to make changes to the notice itself or the documentation. The customer has time for this, but no later than 2 days before the deadline for applications. And if changes are made, then the time for filing should be increased in accordance with paragraph 1 of our article, i.e. up to 15 days from the date of making changes in the case of NMTsK more than 3,000,000 rubles, and up to 7 days from the date of making changes if the contract price is less than or equal to 3,000,000 rubles.

3. If the customer decides to refuse to conduct purchases in electronic form then he can do it no later than 5 days before the end of applications.

4. The participant can send a request for clarification auction documentation, But not later than 3 days before the end of applications. The customer is obliged to publish the answer within 2 days from the date of receipt of this request.

5. A participant in an electronic auction may change or withdraw his application at any time before the deadline for acceptance. If he does not have time to do this within the established period, his first part of the application will be considered and, in case of its compliance, the participant will be admitted to the auction, but he has the right not to submit price proposals.

6. The next stage is the consideration of the first parts of the applications submitted by the participants. It is no more than 7 days after the deadline for submission. According to the changes that came into force on July 1, 2018, if the NMTsK is less than or equal to 3 million rubles, then the period for consideration of part 1 should not exceed 1 working day. During this period, applications that do not meet the requirements for the composition of the first part of the application specified in the documentation are screened out.

At the same time, the protocol for the consideration of the first parts of the application is sent to the ETP operator, on which the purchases take place, and the data is posted in the EIS.

7. Then comes the deadline for the auction under 44-FZ, this business day following the expiration of two days from the date of consideration of the first parts.

For example, if applications were considered on Friday, then the electronic auction will be on Monday, because two days have passed since Friday (Saturday and Sunday), and the working day following these two days is Monday.

8. After that, it is necessary to announce the protocol of the auction. On the electronic procurement platform, this information is posted within 30 minutes after the completion of the last phase of the auction, and the protocol is sent to the customer within 1 hour, along with the second parts of the bids, after publication on the ETP.

9. Consideration of 2 parts of the application must take place on time no more than 3 working days, from the moment of posting the protocol on holding an electronic auction on the site. The final protocol, drawn up after consideration of the second parts of the applications, will determine the winner of the purchase.

10. From the date of posting the final protocol, in which the winner is determined, within 5 calendar days the customer in the personal account of the winner sends him a draft contract.

11. Within 5 calendar days after receiving the draft contract from the customer, the winner must sign the contract on his part, attaching a document on the enforcement of the contract, or send the protocol of disagreements to the customer.

12. If a protocol of disagreements was sent, then three days is given to the customer for its study and publication of the amended version of the contract. If the contract will be placed without changes, then the customer must justify the refusal of the proposed changes by the participant.

13. Over the next 3 working days, after the publication of the modified (or the same) version of the contract, the winner is obliged to sign the contract on his part, attaching a document on the enforcement of the contract.

14 . The customer must sign the contract within 3 working days after the winner does. From this moment the contract is considered concluded.

Please note that the contract cannot be concluded earlier than 10 days from the date of determining the winner, i.е. placement of the final protocol.

15. In the event that the participant's application was rejected for the first / second part or violations were detected on the part of the customer or operator during the auction electronic platform, the participant has 10 days from the date of the final protocol (i.e. from the moment the winner is determined) in order to send a complaint to the FAS.

1. Only participants accredited in accordance with this paragraph and admitted to participate in such an auction may participate in an electronic auction.

2. An electronic auction is held on an electronic platform on the day specified in the notice of its holding and determined taking into account part 3 of this article. The start time of such an auction is set by the operator of the electronic site in accordance with the time zone in which the customer is located.

3. The day of holding an electronic auction is the working day following the expiration of two days from the date of the deadline for consideration of the first parts of applications for participation in such an auction.

4. An electronic auction is held by reducing the initial (maximum) contract price specified in the notice of such an auction, in the manner prescribed by this article.

5. If the documentation on the electronic auction contains the total initial (maximum) price of spare parts for machinery, equipment, or in the case provided for in paragraph 2 of Article 42 of this federal law, the initial (maximum) price of a unit of goods, work or services, such an auction is held by reducing the indicated total initial (maximum) price and the initial (maximum) price in the manner prescribed by this article.

6. The amount of reduction of the initial (maximum) contract price (hereinafter referred to as the "auction step") is from 0.5 percent to five percent of the initial (maximum) contract price.

7. When conducting an electronic auction, its participants submit proposals for the contract price, providing for a reduction in the current minimum offer for the contract price by an amount within the "auction step".

8. When conducting an electronic auction, any of its participants is also entitled to submit a proposal for the price of the contract, regardless of the "auction step", subject to the requirements provided for by part 9 of this article.

9. When conducting an electronic auction, its participants submit proposals for the price of the contract, taking into account the following requirements:

1) a participant in such an auction is not entitled to submit a contract price offer equal to or greater than the contract price offer previously submitted by this participant, as well as a contract price offer equal to zero;

2) a participant in such an auction is not entitled to submit a contract price offer that is lower than the current minimum contract price offer, reduced within the "auction step";

3) a participant in such an auction is not entitled to submit a contract price offer that is lower than the current minimum contract price offer if it is submitted by such an electronic auction participant.

10. From the beginning of the electronic auction on the electronic site until the deadline for submitting contract price bids, all contract price bids and the time of their receipt, as well as the time remaining until the deadline for submitting contract price bids in accordance with part 11 of this article.

11. When conducting an electronic auction, the time for accepting proposals from participants in such an auction on the price of the contract is set, which is ten minutes from the beginning of such an auction until the deadline for submitting proposals for the price of the contract, as well as ten minutes after the receipt of the last proposal for the price of the contract. The time remaining until the deadline for submitting contract price bids is updated automatically using software and hardware tools that ensure such an auction, after the initial (maximum) contract price is reduced or the last contract price bid is received. If during the specified time no proposals for a lower contract price have been received, such an auction is automatically completed using the software and hardware that ensure its conduct.

12. Within ten minutes from the moment of completion in accordance with part 11 of this article of the electronic auction, any of its participants has the right to submit an offer for the contract price, which is not lower than the last offer for the minimum contract price, regardless of the "auction step", subject to the requirements provided for in paragraphs 1 and 3 of part 9 of this article.

13. The operator of an electronic site is obliged to ensure the confidentiality of information about its participants during an electronic auction.

14. During the conduct of an electronic auction, the operator of an electronic site shall be obliged to reject proposals for the price of a contract that do not meet the requirements provided for by this article.

15. Rejection by the operator of the electronic site of proposals for the price of the contract on the grounds not provided for by part 14 of this article is not allowed.

16. If a participant in an electronic auction proposes a contract price that is equal to the price offered by another participant in such an auction, the contract price offer received earlier is recognized as the best.

17. If an electronic auction is held in accordance with part 5 of this article by its participant who offered the most low price of the contract, the person who offered the lowest total price of spare parts for machinery, equipment and the lowest price per unit of work and (or) services for the maintenance and (or) repair of machinery, equipment, the lowest price per unit of service is recognized.

18. The protocol of the electronic auction is posted on the electronic site by its operator within thirty minutes after the end of such an auction. This protocol shall indicate the address of the electronic platform, the date, start and end time of such an auction, the initial (maximum) price of the contract, all minimum contract price offers made by participants in such an auction and ranked in descending order, indicating the serial numbers assigned to applications for participation in such an auction, which are submitted by its participants who made the relevant proposals for the price of the contract, and indicating the time of receipt of these proposals.

19. Within one hour after the protocol specified in paragraph 18 of this article is posted on the electronic site, the operator of the electronic site is obliged to send to the customer the specified protocol and the second parts of the applications for participation in such an auction submitted by its participants, proposals for the contract price of which, when ranked in in accordance with part 18 of this article, received the first ten serial numbers, or, if less than ten of its participants took part in such an auction, the second parts of the applications for participation in such an auction filed by its participants, as well as the documents of these participants, provided for in paragraphs 2 - and 8 of Part 2 of Article 61 of this Federal Law and contained on the date and time of the deadline for filing applications for participation in such an auction in the register of its participants who have received accreditation on the electronic site. During this period, the operator of the electronic site is also obliged to send appropriate notifications to these participants.

20. If, within ten minutes after the start of the electronic auction, none of its participants has submitted an offer for the contract price in accordance with part 7 of this article, such an auction shall be deemed invalid. Within thirty minutes after the end of the specified time, the operator of the electronic site places on it a protocol on recognizing such an auction as failed, which indicates the address of the electronic site, the date, start and end time of such an auction, the initial (maximum) price of the contract.

21. Any participant in an electronic auction, after posting on the electronic site and in the unified information system the protocol specified in part 18 of this article, has the right to send a request to the operator of the electronic site for clarification of the results of such an auction. The operator of the electronic site within two working days from the date of receipt of this request is obliged to provide this participant with the appropriate explanations.

22. The operator of an electronic site is obliged to ensure the continuity of the electronic auction, the reliability of the software and hardware used to conduct it, the equal access of its participants to participate in it, as well as the performance of the actions provided for in this article, regardless of the end time of such an auction.

23. If during the electronic auction the contract price is reduced to half a percent of the initial (maximum) contract price or lower, such an auction is held for the right to conclude a contract. At the same time, such an auction is held by raising the price of the contract based on the provisions of this Federal Law on the procedure for holding such an auction, taking into account the following features:

1) such an auction in accordance with this part is held until the contract price reaches no more than one hundred million rubles;

2) a participant in such an auction is not entitled to submit proposals for a contract price higher than the maximum transaction amount for this participant, specified in the decision to approve or conclude transactions based on the results of such an auction on behalf of the procurement participant, which is contained in the register of participants in such an auction accredited on an electronic site;

3) the amount of the contract performance security is calculated on the basis of the initial (maximum) contract price specified in the notice of such an auction.

1. Only participants registered in the unified information system, accredited on the electronic site and admitted to participate in such an auction can participate in an electronic auction.

2. An electronic auction is held on an electronic platform on the day specified in the notice of its holding and determined taking into account part 3 of this article. The start time of such an auction is set by the operator of the electronic site in accordance with the time zone in which the customer is located.

3. The day of holding an electronic auction is the working day following the expiration of two days from the date of the deadline for consideration of the first parts of applications for participation in such an auction.

4. An electronic auction is held by reducing the initial (maximum) contract price specified in the notice of such an auction, in the manner prescribed by this article.

5. If, in the case provided for by Clause 2 of Article 42 of this Federal Law, the electronic auction documentation indicates the price of each spare part for machinery, equipment, the price of a unit of work or service, such an auction shall be held by reducing the sum of the indicated prices in the manner established by this Article.

7. When conducting an electronic auction, its participants submit proposals for the contract price, providing for a reduction in the current minimum offer for the contract price by an amount within the "auction step".

8. When conducting an electronic auction, any of its participants is also entitled to submit a proposal for the price of the contract, regardless of the "auction step", subject to the requirements provided for by part 9 of this article.

9. When conducting an electronic auction, its participants submit proposals for the price of the contract, taking into account the following requirements:

1) a participant in such an auction is not entitled to submit a contract price offer equal to or greater than the contract price offer previously submitted by this participant, as well as a contract price offer equal to zero;

2) a participant in such an auction is not entitled to submit a contract price offer that is lower than the current minimum contract price offer, reduced within the "auction step";

3) a participant in such an auction is not entitled to submit a contract price offer that is lower than the current minimum contract price offer if it is submitted by such an electronic auction participant.

10. From the beginning of the electronic auction on the electronic site until the deadline for submitting contract price bids, all contract price bids and the time of their receipt, as well as the time remaining until the deadline for submitting contract price bids in accordance with part 11 of this article.

11. When conducting an electronic auction, the time for accepting proposals from participants in such an auction on the price of the contract is set, which is ten minutes from the beginning of such an auction until the deadline for submitting proposals for the price of the contract, as well as ten minutes after the receipt of the last proposal for the price of the contract. The time remaining before the deadline for submitting contract price bids is updated automatically, using software and hardware tools that ensure such an auction, after the initial (maximum) contract price is reduced or the last contract price bid is received. If during the specified time no offer for a lower contract price has been received, such an auction is automatically completed using software and hardware that ensure its conduct.

12. Within ten minutes from the moment of completion in accordance with part 11 of this article of the electronic auction, any of its participants has the right to submit an offer for the contract price, which is not lower than the last offer for the minimum contract price, regardless of the "auction step", subject to the requirements provided for paragraphs 1 and 3 of part 9 of this article.

13. The operator of an electronic site is obliged to ensure the confidentiality of information about its participants during an electronic auction.

14. During the conduct of an electronic auction, the operator of an electronic site shall be obliged to reject proposals for the price of a contract that do not meet the requirements provided for by this article.

15. Rejection by the operator of the electronic site of proposals for the price of the contract on the grounds not provided for by part 14 of this article is not allowed.

16. If a participant in an electronic auction proposes a contract price that is equal to the price offered by another participant in such an auction, the contract price offer received earlier is recognized as the best.

17. If an electronic auction is held in accordance with paragraph 5 of this article, its participant who offered the lowest price of the contract is recognized as the person who offered the lowest total price of spare parts for machinery, equipment and the lowest price of a unit of work and (or) services for technical maintenance and (or) repair of machinery, equipment, the lowest price per unit of service.

18. The protocol of the electronic auction is posted on the electronic site by its operator within thirty minutes after the end of such an auction. This protocol shall indicate the address of the electronic site, the date, start and end time of such an auction, the initial (maximum) price of the contract, all minimum contract price offers made by participants in such an auction and ranked in descending order, indicating the identification numbers assigned to applications for participation in such an auction, which are submitted by its participants who made the relevant proposals for the price of the contract, and indicating the time of receipt of these proposals.

19. Within one hour after the protocol specified in Part 18 of this article is posted on the electronic site, the operator of the electronic site is obliged to send to the customer the specified protocol and the second parts of the bids for participation in such an auction, submitted by its participants, proposals for the contract price of which, when ranked in in accordance with part 18 of this article, received the first ten serial numbers, or, if less than ten of its participants took part in such an auction, the second parts of the applications for participation in such an auction submitted by its participants, as well as information and electronic documents these participants, provided for by Part 11 of Article 24.1 of this Federal Law. During this period, the operator of the electronic site is also obliged to send appropriate notifications to these participants.

20. If, within ten minutes after the start of the electronic auction, none of its participants has submitted an offer for the contract price in accordance with part 7 of this article, such an auction shall be deemed invalid. Within thirty minutes after the end of the specified time, the operator of the electronic site places on it a protocol on recognizing such an auction as failed, which indicates the address of the electronic site, the date, start and end time of such an auction, the initial (maximum) price of the contract.

21. Any participant in an electronic auction, after posting on the electronic site and in the unified information system the protocol specified in part 18 of this article, has the right to send a request to the operator of the electronic site for clarification of the results of such an auction. The operator of the electronic site within two working days from the date of receipt of this request is obliged to provide this participant with the appropriate explanations.

22. The operator of an electronic site is obliged to ensure the continuity of the electronic auction, the reliability of the software and hardware used to conduct it, the equal access of its participants to participate in it, as well as the performance of the actions provided for in this article, regardless of the end time of such an auction.

23. If during the electronic auction the contract price is reduced to half a percent of the initial (maximum) contract price or lower, such an auction is held for the right to conclude a contract. At the same time, such an auction is held by raising the price of the contract based on the provisions of this Federal Law on the procedure for holding such an auction, taking into account the following features:

1) such an auction in accordance with this part is held until the contract price reaches no more than one hundred million rubles;

2) a participant in such an auction is not entitled to submit proposals for a contract price higher than the maximum transaction amount for this participant specified in the decision to approve or conclude transactions on behalf of the procurement participant based on the results of such an auction;

3) the amount of the contract performance security is calculated on the basis of the initial (maximum) contract price specified in the notice of such an auction.

How the bid step system works

Is it possible to increase the bet by an amount greater than the size of the standard step?

The bet can be increased by a number higher than the standard step, if necessary:

    reach the starting price. For auctions with a starting price, we will automatically increase your bid until the starting price is reached, after which bidding will continue. However, we will not exceed your current maximum bid.

    interrupt the highest bid a competing bidder. We will increase your bid by a number greater than the bid increment to outbid another bid without exceeding your maximum bid amount.

Can my bet be outbid by the amount of an incomplete step?

Your bet can be outbid by the amount of an incomplete step. The bid of the winning bidder must exceed the next maximum bid by only one cent.

Example:

    You are the first bidder for an item with a starting price of $8.50 and your maximum bid is $20. Your initial bid will be $8.50. If a second bidder bids $9, your bid will be automatically raised to $9.50.

    If a third bidder bids $20.01, he will become the leading bidder at $20.01. Since the $20.01 bid is over $10 and more than your maximum bid, the third bidder will win the auction unless you increase your bid or another bidder bids a higher maximum bid.
